Will your overseas marriage be recognised in the UK?
A marriage conducted abroad is generally recognised in England and Wales if it was validly performed under the law of the country where it took place and both of you had the legal capacity to marry each other. It does not need to be separately registered in the UK to be legally valid here, though you may want to record it for practical purposes.
The general rule
English law generally recognises a marriage as valid if the formalities were correctly followed in the country where the ceremony took place, and both parties had capacity to marry under English law — for example, neither was already married to someone else and both were old enough.
Where recognition can be questioned
Problems can arise if the ceremony did not meet the formal legal requirements of the country it took place in, if it was a religious-only ceremony not recognised as a civil marriage there, or if one party lacked capacity under English law.
Evidencing your marriage in the UK
You do not need to register a valid overseas marriage in England and Wales for it to count, but you will typically use your original overseas marriage certificate, with a certified translation if needed, as evidence for purposes such as changing your name or immigration applications.
What this means for you
- Keep your original overseas marriage certificate safe — you will need it as ongoing proof, not a UK-issued equivalent.
- If your ceremony abroad was religious-only and not registered locally as a civil marriage, get advice on whether it is legally recognised at all.
